We previously posted a news article providing information on the Rent Freeze and Eviction Ban that had been put in place by Scottish Government to protect tenants from losing their home and being put under financial pressure by rising housing costs.
Whilst the initial rent freeze ended earlier in the year, this was changed to a ‘rent cap’, where private landlords can increase rent: by up to 3% if they send you a valid rent increase notice (3 months’ notice in writing), or up to 6% if they apply to Rent Service Scotland. Whilst the rent cap remains in place, and currently applies until the end of September 2023, there are plans to extend this until March 2024.
The eviction ban has also been further extended to March 2024. Your landlord is still able to apply for an eviction order, but if granted, this could be delayed by up to 6 months. However, there are still some cases where an eviction can be granted and enforced sooner, such as:
As always, the landlord would be required to gain a court order to enable them to enforce any eviction notice. People often panic when they receive a ‘Notice to Quit’ or ‘Notice to Leave’ from their landlord. However, unless the required order has been obtained by the Court or Tribunal, tenants are not required to vacate the property.
